Terms of Service

1. Introduction

Welcome to FamiShare ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our mobile application FamiShare (the "App") operated by Maciej Karbowski ("Company," "we," "our," or "us").

By downloading, installing, accessing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the App.

2. Definitions

• "Account" means the user profile you create when using the App
• "Content" means any information, data, text, or other materials you provide through the App
• "Expenses" means the financial information and expense records you enter into the App
• "Group" means a collection of users who share expenses within the App
• "Services" means the expense tracking and sharing functionality provided by the App
• "User," "you," or "your" refers to the individual person using the App

3. Description of Services

FamiShare is an expense-sharing application that allows users to:

• Record and track shared expenses with friends and family
• Calculate how much each user owes to others in a group
• Maintain records of expense sharing arrangements

Important: Our App does not process payments, handle financial transactions, or transfer money between users.

4. User Accounts and Registration

4.1. Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.

4.2. Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

4.3. Account Termination

You may terminate your account at any time through the Account page in the App. We may suspend or terminate your account at our discretion if you violate these Terms.

When you delete your account, the data shared with other Users may not be deleted from the App. For example, expense information shared with a Group may still be required to provide Services to other Users and it will not be deleted. However, your display name and email will be anonymised.

5. User Content and Data

5.1. Your Content

You retain ownership of all expense information, personal data, and other content you provide through the App ("User Content"). By using the App, you grant us a limited license to process your User Content to provide and improve our Services.

5.2. Content Guidelines

You agree that your User Content will not:

• Contain false, misleading, or fraudulent information
• Violate any applicable laws or regulations
• Infringe upon the rights of any third party
• Contain malicious code or harmful materials

5.3. Data Accuracy

You are responsible for the accuracy of all expense information and data you enter into the App. The App's calculations are based solely on the information you and other group members provide.

6. Groups and Shared Expenses

6.1. Group Participation

By joining or creating a group, you agree to share expense information with other group members. All group members can view shared expense details and balances within that group.

6.2. Expense Settlement

The App only calculates and displays who owes what to whom based on entered expenses. Users are responsible for settling actual payments outside of the App through their preferred payment methods.

6.3. Group Administration

Group members can leave groups at any time.

7. Prohibited Uses

You agree not to use the App:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any applicable laws, regulations, or these Terms
• To harass, abuse, insult, harm, defame, or intimidate any person
• To submit false or misleading information
• To impersonate any person or entity or falsely state your affiliation with any person or entity
• To interfere with or circumvent the security features of the App
• To engage in any automated use of the system or collect user information for unauthorized purposes

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding your personal information.

9. Third-party Services

The App may contain links to or integrate with third-party websites, services, or applications. For example, a third-party system may be used for sending emails related to sign-up and group invitations. We are not responsible for the content, privacy policies, or practices of any third-party services.

10. App Availability and Updates

10.1. Availability

We strive to maintain the App's availability but cannot guarantee uninterrupted service. The App may be unavailable due to maintenance, updates, or circumstances beyond our control.

10.2. Updates

We may release updates to improve the App's functionality, security, or user experience. Some updates may be required to continue using the App.

11. Disclaimers and Warranties

11.1. "As Is" Basis

The app is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied.

11.2. No Financial Advice

The app provides expense tracking and calculation tools only. We do not provide financial, legal, or tax advice. Consult qualified professionals for such advice.

11.3. Calculation Accuracy

While we strive for accuracy in our calculations, you are responsible for verifying all expense calculations and settlements.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall FamiShare, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the app.

Our total liability to you for all claims arising from or relating to the app shall not exceed the amount you paid to us for the app in the twelve months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless FamiShare and its affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

14. Modification of Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after such notification constitutes acceptance of the modified Terms.

15. Termination

15.1. Termination by You

You may stop using the App at any time and delete it from your device.

15.2. Termination by Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.

15.3. Effect of Termination

Upon termination, your right to use the App ceases immediately. We may retain certain information as described in our Privacy Policy.

16. Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Poland.

17. EU Users - Additional Rights

If you are a user in the European Union, you have additional rights under applicable EU laws, including:

• The right to withdraw from distance contracts within 14 days
• Rights under the EU General Data Protection Regulation as described in our Privacy Policy
• The right to file complaints with relevant EU authorities

18. Children's Use

The App is not intended for use by children under 13 years of age. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided personal information, please contact us immediately.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior and contemporaneous agreements.
